THE SHORT ANSWER

Delta-9 is the main form of THC the hemp plant produces. Delta-8 is a milder cousin that's usually made from CBD in a lab. THCA is the raw, non-intoxicating acid that becomes Delta-9 when heated. Starting December 11, 2026, federal law counts all of them toward total THC, so products built on any of the three lose hemp status above 0.4mg per container.

Delta-9 THC

Delta-9 is the THC most people mean when they say THC — the compound behind the classic effects of an edible. Hemp-derived Delta-9 products have been legal federally as long as the product stays at or under 0.3% Delta-9 by dry weight, which is how gummies, drinks and baking mixes like ours could be sold as hemp. Delta-8 THC

Delta-8 has almost the same structure as Delta-9, with one bond in a different spot. People commonly describe it as milder. The plant makes only trace amounts, so nearly all Delta-8 on the market is produced by chemically converting CBD. That process — and the loose testing around it — is a big part of why Congress rewrote the hemp definition.

THCA

THCA is what the plant actually produces before heat gets involved. It isn't intoxicating on its own, but smoking, vaping or baking converts it to Delta-9. HHC, THC-O and other lab-made THC

HHC is made by hydrogenating hemp-derived compounds; THC-O is a synthetic acetate the plant doesn't make at all. Both have far less research behind them than Delta-9. Under the new definition, cannabinoids synthesized or manufactured outside the plant don't count as hemp, and compounds the plant can't naturally produce, like THC-O, lose hemp status first — on November 12, 2026.

Which is strongest?

Milligram for milligram, Delta-9 is the benchmark. Delta-8 is commonly described as noticeably milder. THCA isn't intoxicating until it's heated — then it is Delta-9. Why the hemp ban treats them the same

The new federal definition measures total THC — every form of THC, including THCA — and caps finished products at 0.4mg per container.
