Are THC Gummies Being Banned? Delta-9, Delta-8 and the December 11 Hemp Rule

THE SHORT ANSWER

Yes. Starting December 11, 2026, a hemp product can contain no more than 0.4 milligrams of total THC per container. One 5mg Delta-9 gummy is 12.5 times that, and a 20-count jar is 250 times it. Delta-9, Delta-8 and THCA all count toward total THC, so virtually every intoxicating hemp gummy loses its federal legal status.

Why gummies are hit hardest

Gummies are the best-selling hemp THC product in the country: cheap to make, easy to dose and sold everywhere from smoke shops to gas stations. They're also the clearest example of what the new law targets — products sold as hemp that are made to be felt. And the new limit applies to the whole container, not to each gummy:

What about Delta-8 gummies?

Delta-8 gets no loophole. The new definition counts all forms of THC toward the limit, and most Delta-8 is made by chemically converting CBD — while the new definition also excludes cannabinoids synthesized or manufactured outside the plant. Compounds the plant can't make at all, like THC-O, lose hemp status even sooner, on November 12, 2026. Delta-8 and Delta-9 gummies fall under the December 11 date. What about CBD gummies?

THC-free CBD gummies (made with isolate or broad-spectrum CBD) are generally unaffected. Full-spectrum CBD gummies contain trace THC, and because the cap is per container, a whole jar can add up to more than 0.4mg. Check the certificate of analysis for total THC per package. Gummies vs. baked edibles before the deadline

If you're choosing what to buy before December 11, the format matters:

  • Gummies are convenient, but heat and humidity make them sweat, stick and lose texture over time.
  • Fresh baked edibles are the most perishable — days on the counter, not months.

Not hemp-derived gummies over the new limit. After the deadline, THC gummies are sold only through state-licensed dispensaries.
