What THC Products Will Still Be Legal After December 11?

THE SHORT ANSWER

After December 11, 2026, a hemp product is legal under federal law only if it contains 0.4 milligrams of total THC or less per container and no synthetic cannabinoids. THC-free CBD, hemp seed foods and hemp fiber are unaffected. THC products you can actually feel will be sold only through state-licensed dispensaries in states that have them.

Is CBD being banned?

No — but some CBD gets caught. The rule is about THC, and THC-free CBD made from isolate or broad-spectrum extract doesn't contain enough to matter. Full-spectrum CBD is different: it keeps trace THC on purpose, and because the limit is 0.4mg per container, a full bottle of tincture or jar of gummies can add up to more than that. Look at the certificate of analysis for total THC per container, or choose THC-free.

Where to buy THC and cannabis after December 11

State-licensed cannabis dispensaries. In states with medical or adult-use programs, dispensaries sell THC products under state law and state testing rules, and the federal hemp change doesn't close them. In April 2026 the federal government also moved state-licensed medical products to Schedule III; a decision on the broader category is still pending.

Can you still buy THC online?

Not hemp-derived THC above the new limit. Shipping those products nationwide depended on the hemp definition, and that ends December 11 — for us too. Expect a few sellers to keep going anyway. Beyond the legal risk, those are the products least likely to have honest labels or current lab tests, and payment companies are already cutting hemp sellers off: Square told merchants to remove hemp and CBD products by October 15.

What about products you already own?

The federal change redefines what counts as hemp starting December 11. It doesn't say anything specific about products people already bought, and possession is governed by both federal and state law. We can't give legal advice here — check your state's guidance.
